NNB lawyers publish an article about the list of the first administrative processes due to violations of the GDPL

The National Data Protection Authority (ANPD in Portuguese) published the list of the first administrative sanctioning processes initiated by its General Inspection Coordination due to non-compliance with the Brazilian General Data Protection Law (LGPD in Portuguese).

The lawsuits address the same categories of violations, such as:

  • Absence of appointment of a Data Protection Officer (DPO); 
  • Failure to report incidents to data subjects; 
  • Lack of compliance with ANPD requests; 
  • Absence of adequate security measures; 
  • Absence of accountability documents.

All administrative procedures initiated by the ANPD were registered between March and September 2022, and are in the initial investigation phase for the collection of evidence. Of the eight cases listed, seven were filed against public entities.
