The General Law for the Protection of Personal Data (Law No. 13.709/2018) provides a specific section for the processing of children and teenagers data. However, article 14 of the law has been the subject of numerous questions among academics, professionals and representatives of civil society, due to the insecurity that its wording brings to treatment agents, especially due to the uncertainty about which legal hypotheses authorize the treatment of children and teenagers personal data.
In an article published by the International Association of Privacy Professionals (IAPP), Juliana Peixinho and Carlos Eduardo Eliziario de Lima, lawyers at NNB Advogados, comment on a study by the National Data Protection Authority (ANPD) on the legal hypotheses for processing personal data of children and teenagers and their practical implications.
