Brazilian Telehealth law comes into force

Law No. 14,510/22 rules the Telehealth, widespread practice in the pandemic
On December 28th, 2022, the Brazilian government published the Law No. 14,510/2022, which is responsible for regulating telehealth in Brazil – a practice defined as the provision of health services at distance through information and communication technologies, as well as by observing several principles indicated in the law.
This law determines that companies that hire medical professionals, directly or indirectly, for the exercise of telemedicine must obtain a registration from the State Council of Medicine of the place where they are established, as well as their medical technical director. Furthermore, the law also provides that the acts of the healthcare professionals practiced within telemedicine will be valid throughout Brazil.
Federal Professional Councils will be responsible for defining the ethical and moral guidelines that should be applied in the provision of the telemedicine services, as well as the form of auditing, as occur in the traditional and live activities.
Law No. 14,510/22 provides healthcare professionals with greater legal certainty and independence to telemedicine services in Brazil, leaving it at their discretion to use the modality or not.
